Deferred Management Fee (DMF) Court Ruling Update

On Friday, 21 August 2026, the Court of Appeal determined that Lifestyle Communities was unsuccessful in its appeal of the orders made by President Woodward in VCAT on 25 July 2025 and, as a result, upheld those orders.

Following consideration of the Court's decision, the company has decided not to appeal the Court of Appeals’ decision relating to Deferred Management Fee (DMF) terms in certain Lifestyle Communities’ site agreements.

Lifestyle Communities has engaged Deloitte to establish and administer a program for managing refund requests from former homeowners who have paid a DMF. 

Our aim is to enable past homeowners to apply for repayment of the DMF in a secure, streamlined manner. Each application will be considered on a case-by-case basis.
